CONTRIBUTOR RELEASE FORM TEXT - FOR REVIEW PURPOSES ONLY

In consideration of my engagement as a contributor, and for other good and valuable consideration herein acknowledged as received and to be received, I hereby grant the following rights and permissions to PERJUS LLC, on behalf of dates magazine (collectively, “Brand”), its legal representatives, and assigns, those for whom Brand is acting, and those acting with its authority and permission. Brand shall have the absolute, irrevocable, perpetual, and unrestricted right and permission to take, use, re-use, publish, and republish the works identified below (“Content”), in whole or in part, or composite or distorted in character or form, individually or in connection with other material, in conjunction with or without my name or a fictitious name, without restriction as to changes or alterations, and to reproduce the Content in color or otherwise, made through any medium at Brand’s studios or elsewhere, and in any and all media now or hereafter known, including without limitation print media, social media, and distribution over the internet for illustration, promotion, art, editorial, advertising, trade, or any other purpose whatsoever, provided that the Content will only be used in, or for the benefit of, PERJUS Magazine and/or dates magazine, including without restriction their promotion. The Content will not be altered using artificial intelligence or generative AI technologies in a way that changes the original meaning or appearance of the image. I understand that the Content may be cropped, edited, or arranged for layout and presentation purposes. Any edits, cropping, or layout adjustments to the Content will be made in a reasonable manner and will not intentionally alter the original meaning or intent of the Content. Any promotional use of the Content will be directly related to the promotion of PERJUS Magazine and/or dates magazine and will be used in a reasonable and good-faith manner. I hereby waive any right that I may have to inspect or approve the finished use of the Content, or any printed or electronic material used in conjunction with the Content, now or in the future, whether that use is known to me or unknown. I understand that if the Content is chosen for publication, it may be used in the print magazine and/or for promotional purposes for PERJUS Magazine and/or dates magazine. The Content is being contributed for an editorial and artistic publication and will be used solely in connection with PERJUS Magazine and/or dates magazine. The Content will not be sold, licensed, or otherwise distributed as standalone images to third parties outside of PERJUS Magazine and/or dates magazine. If the Content includes identifiable individuals other than the Contributor, such Content will not be used unless a valid model release has been obtained for each such individual. I hereby release, discharge, and agree to hold harmless Brand, its legal representatives, and assigns, and all persons acting under its permission or authority or those for whom it is acting, from any liability, including without limitation any claims for libel or violation of any right of publicity or privacy. I hereby disclaim and waive any right to future royalties or other compensation arising from or related to the use of the Content I understand PERJUS Magazines are printed to order, and Brand does not provide free print copies under any circumstances at this time. I understand and accept that I will not receive a free copy of the print magazine if my work is chosen for publication. I hereby agree to defend and hold harmless Brand, its legal representatives, assigns, agents, employees, and all persons acting under its permission or authority or those for whom it is acting, against any claims, damages, or liability, including reasonable attorney’s fees, arising from any misrepresentation I make in this Release. This Release and all disputes arising hereunder shall be governed by, and construed in accordance with, the laws and decisions of the State of New York, without giving effect to the principles thereof relating to conflicts of law. I irrevocably agree that the federal and state courts of New York, County of New York, shall have sole and exclusive jurisdiction over any suit or other proceeding arising out of or based upon this Release. I submit to the venue and jurisdiction of such courts and irrevocably consent to personal jurisdiction by such courts. I hereby warrant that I am over the age of eighteen (18), legally and mentally competent, have the right to contract in my own name, and have the right to grant any and all rights and permissions granted hereunder. I have read the above authorization, release, and agreement, prior to its execution, and am fully familiar with the contents of this document. I acknowledge that I have been given the opportunity to review this Release with personal legal counsel, and have utilized that opportunity to the extent that I wish to do so. The rights granted under this Release shall inure to the benefit of the agents, employees, successors, heirs, legal representatives, licensees, and assigns of Brand. This Release shall be binding upon me and my heirs, legal representatives, successors, and assigns.
